HB 153 (Kasich’s Budget Bill) becomes effective on September 28, 2011. Unlike Senate Bill 5, it appears that Ohio’s unions do not intend to seek referendum on this legislation. This bill will not impact existing collective bargaining agreements, but here are just some of the changes that school districts can expect when current agreements expire:

  1. A new teacher evaluation framework will be created by the state board of education for schools to follow. This framework will be standards-based and include a method for student performance to be taken into consideration.
  2. Seniority will no longer be a consideration for reductions in force (and rehiring when positions become available again) except in limited circumstances.
  3. Core-subject teachers in buildings ranked in the lowest 10% will be required to retake all written exams needed for licensure in the teacher’s subject area and grade level.
  4. Buildings ranked by the State in the lowest 5% for three consecutive years may be closed or required to restructure.
